Lawyers explain if Astronomer CEO Andy Byron can sue Coldplay

While neither Byron nor Cabot have made any public comments, online conversations have exploded with theories and speculation—including whether Byron could potentially pursue legal action against Coldplay or the concert organizers for the viral moment that some argue contributed to the fallout.

However, legal experts say that even if Byron considered this route, any such case would be extremely unlikely to succeed.

“Any legal claims from Byron would be dead on arrival,” said Ron Zambrano, an employment law attorney with West Coast Employment Lawyers, in a statement to The Mirror.

Zambrano elaborated that not only would such a lawsuit potentially infringe on the band’s creative expression during their performance, but also that attendees of public events like concerts typically have no expectation of privacy.

“Byron and Cabot waived their right to privacy when they attended a public event,” he explained. “Their public display of affection is on them, not on Coldplay. They just got caught.”

Tre Lovell, a civil and entertainment attorney at The Lovell Firm, agreed with that assessment, emphasizing the legal distinction between public moments and protected image rights.

“When you are out in public, you have no right to privacy for your actions. People are free to photograph and video you,” Lovell said.

He clarified that legal issues could potentially arise if someone profits from another’s image without permission, or if footage is edited to be misleading or defamatory. However, nothing in this particular situation, according to Lovell, crosses those lines.

“There’s no violation of publicity rights or defamation here. This appears to be a straightforward public moment that simply happened to gain viral attention,” he said.

While the situation has undoubtedly been a difficult and unexpected turn in Byron’s professional life, the legal path appears closed—at least when it comes to holding Coldplay or the event organizers accountable.

For now, the clip continues to circulate, sparking conversations not only about professional conduct and personal boundaries but also about the increasing scrutiny of public figures in the social media age.
