Melania Trumps US Visa Sparks Controversy as Lawmakers Question Her Immigration Path

Melania Trump’s route to U.S. residency has once again come under scrutiny as lawmakers examine her use of the EB-1 visa—an elite immigration category reserved for individuals with “extraordinary ability” in fields such as science, arts, business, or athletics. Often called the “Einstein visa,” the EB-1 typically grants entry to Nobel laureates, Olympic champions, and internationally recognized experts.

Melania, who was a model from Slovenia at the time, received this visa in 2001. More than 20 years later, questions remain about whether her career met the visa’s high standards.

During a recent House Judiciary Committee hearing, Democratic Representative Jasmine Crockett highlighted concerns about potential double standards. She pointed out that while most immigrants endure extensive scrutiny, Melania’s background as a fashion model did not align with the typical qualifications expected for the EB-1 visa. Crockett stated, “Extraordinary ability means achievements like winning Pulitzers, Emmys, or Olympic medals—not appearing in magazines.”

Supporters of Melania, mainly Republican lawmakers and advocates, defend her eligibility by noting her international modeling success, notable magazine appearances, and earnings above industry peers—factors that satisfy some of the U.S. Citizenship and Immigration Services (USCIS) criteria for EB-1 approval. These include evidence of national or international recognition and leading roles in distinguished organizations.
